Trump ne Birthright Citizenship ke khilaf Supreme Court mein appeal kiya
Reports ke mutaabik, President Donald Trump ne apne pehle din office mein birthright citizenship khatam karne ka executive order sign kiya tha. Is order ke against Maryland, Massachusetts aur Washington state ki federal district courts ne rok laga di thi.
Birthright citizenship kya hai?
Birthright citizenship ka matlab hai ki agar koi bachcha America mein paida hota hai, toh woh automatically American citizen ban jata hai. Yeh US Constitution ke 14th Amendment mein likha hua hai. Trump ka order un bachchon ke liye ise khatam karna chahta hai jinke parents illegal ya temporary visa pe US mein hain.
Supreme Court mein appeal
Justice Department ne Supreme Court se request ki hai ki lower courts ke injunctions ko sirf un plaintiffs tak limit kiya jaye jinke cases court mein hain. Acting solicitor general Sarah Harris ne is request ko “modest” bataya aur abhi Supreme Court se is baat pe koi faisla nahin maanga ki birthright citizenship khatam karna constitutional hai ya nahin.
Trump administration ki mushkilein
Trump administration ko illegal immigration rokne, government budget kam karne aur federal workforce ghatane ki koshishon mein kai legal challenges ka samna karna pad raha hai. California mein ek district judge ne 6 federal agencies ko order diya hai ki woh hajaro probationary workers ko vapas rakhen jinhen nikala gaya tha.

Harris ne apne brief mein kaha ki district court judges Trump administration ke khilaf bahut jyada injunctions jaari kar rahe hain. Unhone kaha ki yeh “epidemic proportions” tak pahunch gaya hai aur executive branch ko apna kaam karne se rok raha hai.
14th Amendment kya kehta hai?
14th Amendment kehta hai ki “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” Trump ka order is baat pe based hai ki jo log illegally ya visa pe US mein hain, woh US ke “jurisdiction” ke under nahin aate.
Judge Coughenour ka faisla
Washington state mein case sunne wale Judge John Coughenour ne president ke executive order ko “blatantly unconstitutional” bataya. Unhone kaha ki apne 4 decades ke career mein unhone aisa clear-cut case nahin dekha.
Supreme Court ka role
Conservative-dominated Supreme Court, jismein Trump ke nominate kiye 3 justices bhi hain, ab is case mein important role ada karega. Yeh dekhna hoga ki Supreme Court Trump ke executive power ki limits aur judiciary ke pushback ko kaise balance karta hai.
