Supreme Court ne Waqf Act ke kuchh provisions pe rok lagane ka socha
Aaj Supreme Court ne kaha ki woh Waqf (Amendment) Act, 2025 ke kuchh important hisson pe rok laga sakti hai. Iss Act mein courts dwara declare kiye गए waqf properties ko denotify karne ka power aur central waqf councils and boards mein non-Muslims ko include karna jaise provisions hain.

Center ne is order ka virodh kiya aur kisi bhi interim order se pehle detailed hearing ki maang ki.
72 petitions ki sunwai
Chief Justice Sanjiv Khanna, Justice Sanjay Kumar aur Justice K V Viswanathan ki bench ne Waqf (Amendment) Act, 2025 ki validity ko challenge karne wali 72 petitions ki sunwai ki.
Non-Muslims ko councils mein shaamil karne pe sawal
Bench ne central waqf councils aur boards mein non-Muslims ko shaamil karne pe sawal uthaya aur Center se poocha ki kya woh Hindu religious trusts mein Muslims ko shaamil karne ko taiyar hai.
Interim order ka proposal
CJI ne notice issue karne aur interim order pass karne ka proposal rakha taki ‘equities balance’ ho sake.
Kuchh provisions ke gambhir parinaam ho sakte hain
CJI ne kaha ki kuchh provisions, khaaskar woh jo judicially recognized waqf properties ko kamzor karte hain, unke gambhir parinaam ho sakte hain.
Court ne kya kya roka ja sakta hai bataya
CJI ne kaha ki jab tak court Waqf Amendment Act 2025 ko challenge karne wali petitions ki sunwai kar raha hai, tab tak courts dwara waqf declare kiye गए properties, chaahe woh waqf-by-user hon ya waqf by deed, unhen denotify nahi kiya jana chahie.
Bench ne amended law ke ek provision ko bhi rokne ka ishara diya, jiske hisab se collector ki inquiry ke दौरान, jab woh yeh decide kar raha ho ki property government land hai ya nahi, waqf property ko waqf nahi mana jayega.
CJI ne kaha, “Waqf boards aur central waqf council ke sabhi members, ex-officio members ke alawa, Muslims hone chahie.”
Bench ne Act ke kai aspects pe aapatti jatayi
Bench ne Act ke provision-wise objections pe gaur kiya aur central waqf council aur state waqf boards mein non-Muslims ko shaamil karne samet kanoon ke kai aspects pe aapatti jatayi.
Isne district collectors ko waqf properties se jude disputes suljhane ka power dene aur competent courts dwara waqf declare kiye गए properties ko denotify karne ki anumati dene wale provisions par bhi aapatti jatayi.
Waqf by user kya hai?
Waqf by user ek aisi practice hai jahan kisi property ko, lambे समय se bina kisi rukawat ke religious ya charitable kaam ke liye use kiye jaane ke आधार par, waqf mana jata hai, chaahe owner ne formal, written waqf declaration na diya ho.

Mehta ne kaha ki Muslims ka ek bada hissa Waqf Act ke under govern nahi hona chahta.
Bench ne Mehta se poocha, “Kya aap yeh keh rahe hain ki ab se aap Muslims ko Hindu endowment boards ka hissa banne denge? Khulkar kahiye.”
Bench ne kaha, “Aap past ko rewrite nahi kar sakte.”
