J&K CEO Refers Complaint Against BJP Candidate’s Affidavit Discrepancy to Election Commission

The complaint, submitted to the J&K CEO’s office on April 12, 2023, alleged that the candidate, Jugal Kishore Sharma, had mentioned different liabilities towards banks and financial institutions in his affidavits dated March 23, 2019 and March 30, 2024. The complainant argued that the Returning Officer, Sachin Kumar Vaishya, Deputy Commissioner, Jammu, had not fulfilled his obligation under Section 36 of the Representation of People Act, 1951 to consider and decide on the objections raised.

According to the complainant, the Returning Officer had informed him on April 7 to approach court, effectively disregarding his objections. The complaint further accused the Returning Officer of ‘shunning his responsibility’, which the complainant claimed amounted to dereliction of duties under Section 36 of the Representation of People Act, 1951.

The J&K CEO forwarded the representation to the EC on April 15, 2024, seeking ‘appropriate action’ from the Commission.
