Arizona Secure the Border Act: Local Police Empowered to Arrest Illegal Crossers

Following a 16-13 vote along party lines, Arizona’s Senate has approved a proposed ballot measure designed to enhance border security. This measure, dubbed the “Secure the Border Act,” empowers local law enforcement to apprehend individuals illegally crossing the US-Mexico border into Arizona. The proposal criminalizes unauthorized entry into the state, allowing local and state police to arrest violators. Furthermore, it authorizes state judges to sentence convicted offenders, who face up to six months in jail for initial offenses, and order their deportation upon completion of their sentences. Alternatively, judges may dismiss charges if the accused agrees to return to their home country. According to proponents of the measure, Arizona should take action to address the issue of illegal immigration given the inaction of the federal government. They contend that the increasing number of illegal crossings poses a threat to Arizona’s safety and resources. Some supporters also allege that illegal migrants engage in identity theft and misuse public benefits. However, opponents of the proposal raise concerns about its potential negative impact on Arizona’s economy, law enforcement capabilities, and civil rights. They argue that it could lead to racial profiling of both illegal migrants and American citizens, and divert law enforcement resources from other pressing matters. Furthermore, they assert that the measure is unnecessary, as the federal government already criminalizes unauthorized border crossings. The proposal, which has undergone revisions to address concerns raised by Republican Senator Ken Bennett, now proceeds to the Republican-controlled House for consideration. If the entire state legislature approves it, it will bypass Governor Katie Hobbs, who has previously vetoed similar border protection measures, and be put to a vote by Arizona’s electorate in the November elections.
