In an effort to bolster abortion protections amidst legal disputes, the Biden administration has announced new measures. The Department of Health and Human Services (HHS) recently released a regulation extending HIPAA privacy protections to abortion data, safeguarding sensitive health information from potential prosecution in states with restrictive abortion laws.
This regulation aims to protect patients and healthcare providers in restrictive states by limiting access to data that could be used for prosecution. Since the Supreme Court overturned Roe v. Wade in June 2022, fourteen states have enacted near-total abortion bans, while legal battles continue in several others.
HHS Secretary Xavier Becerra emphasized the limitations of the administration’s authority to fully restore abortion rights, highlighting the need for a national law that reinstates Roe v. Wade. The administration’s commitment to protecting reproductive rights was further demonstrated by its support for an HHS policy requiring emergency rooms to provide abortion services in life-threatening situations, regardless of state laws. The Supreme Court is set to hear arguments for this policy on Wednesday.
