The Calcutta High Court on Tuesday ordered the transfer of the rape and murder case of a Kolkata doctor to the Central Bureau of Investigation (CBI). The court expressed serious concerns about the potential for evidence tampering and directed the immediate handover of all case documents to the CBI.
The court’s decision to transfer the investigation stems from a belief that the state police might not be able to conduct a thorough and impartial investigation. The bench cited the lack of significant progress in the case even after five days as a key reason for their decision.
The court’s order also directed the state counsel to transfer the case diary and other records to the CBI by 10 AM on Wednesday, August 14. Furthermore, the CBI has been instructed to submit periodic reports on the progress of the investigation.
The court’s decision comes after a public outcry and protests over the incident. The parents of the deceased doctor had filed a petition seeking a court-monitored investigation, while several public interest litigations (PILs) demanded a CBI probe.
The protests, which spread across various states, prompted the court to appeal for their cessation. The court acknowledged the emotional response of the medical community but urged doctors to resume their duties, highlighting the importance of providing healthcare to all, especially those who depend on government hospitals.
The Calcutta High Court also ordered the Professor (principal) of the college to immediately proceed on leave, failing which the court would take further action.
Protesters welcomed the court’s decision, expressing hope for a swift and effective investigation by the CBI. They believe that this transfer will ensure justice for the deceased doctor and hold the perpetrator accountable.
