Delaware Speeds Up Recreational Marijuana Program, Applications Open August 19

Delaware is set to launch its recreational marijuana program earlier than expected, with applications for licenses opening on August 19, 2024. This comes just weeks after Governor John Carney approved three cannabis-related measures. The application window, originally scheduled for later in the month, has been extended to September 30, 2024, giving potential business owners more time to prepare.

The state’s Office of the Marijuana Commissioner (OMC) will accept applications for all aspects of the recreational cannabis market, including cultivation, product manufacturing, retail, and testing. A total of 125 licenses will be available, distributed across three categories:

The OMC will prioritize social equity applicants and micro-businesses in the license allocation process. Licenses will be distributed across different counties.

To assist applicants, the OMC has provided comprehensive resources on its website, including detailed guidance, application templates, and a document matrix. Applicants must submit a comprehensive operation plan, outlining their business plan with financial statements, safety and security protocols, diversity and staffing plans, and a regulatory history disclosure. Applicants seeking licenses for cultivation or product manufacturing will also need to provide an environmental sustainability plan and a quality assurance plan.

Applicants will enter a lottery system, with selections expected in late October. Successful applicants will then be issued licenses starting in November.
