Election Commission Bans Exit Polls in Jharkhand, Maharashtra Assembly Elections and Bypolls

In a move aimed at ensuring a level playing field during upcoming elections, the Election Commission of India (ECI) has prohibited the release of exit polls. The ban applies to the Assembly elections in Jharkhand and Maharashtra, as well as bypolls in two parliamentary and 48 legislative constituencies across the country. The restriction, enforced under the Representation of the People Act, 1951, will be in effect from 7:00 AM on November 13th, 2024, to 6:30 PM on November 20th, 2024.

The ECI’s notification, issued on Monday, October 21st, 2024, explicitly prohibits conducting, publishing, or publicizing exit polls through print, electronic media, or any other means. This includes disseminating the results of any exit poll related to the aforementioned general and by-elections.

Furthermore, the notification clarifies that displaying any election-related material, including opinion poll results or other survey data, on electronic media will be banned during the 48 hours leading up to the conclusion of polling in each respective election.

The ECI’s decision to ban exit polls is a routine practice during elections. It is aimed at preventing any potential influence or bias that such polls might exert on voters’ choices. The ban ensures that voters make their decisions based on genuine considerations rather than being swayed by pre-election predictions.

Maharashtra Assembly elections are scheduled to take place on November 20th, while Jharkhand polls will be conducted in two phases, on November 13th and 20th. The results of both Assembly elections will be declared on November 23rd. The by-elections for 47 assembly seats and the Wayanad Lok Sabha seat are also scheduled for November 13th.

The ECI has made it clear that any violation of the exit poll ban will be met with legal consequences. Individuals found contravening these provisions will be subject to imprisonment for a term that may extend to two years, or a fine, or both. This stern measure underscores the ECI’s commitment to upholding the integrity and fairness of the electoral process.
