Fly-Tipper Faces Fine and Driving Ban for Alleyway Dumping

Daniel Chiwoko, a 49-year-old resident of Longford Street in Gorton, has been fined and banned from driving for three months after being found guilty of fly-tipping in Moss Side. On December 21, 2021, Chiwoko parked his white Ford Transit in front of residential waste containers on Beresford Street and proceeded to fill them with building materials and household waste until they were overflowing. He then went on to dump additional items that were too large to fit into the containers in the adjacent alleyway. A local resident witnessed the incident and sent photographic evidence to the Environmental Crimes Team, who subsequently traced the vehicle to Chiwoko. Chiwoko was invited to a recorded interview on April 21, 2022, where he admitted to the offense when confronted with the witness’s photographs. He claimed that he believed he could dispose of the waste in the residential containers as he was helping a friend who lived nearby, but he failed to provide any details about this individual. Chiwoko pleaded guilty to the fly-tipping offense under the Environmental Protection Act 1990 Section 33(5) at a hearing in June 2023 and was sentenced at Manchester Magistrates Court on April 24. He received a 12-month community order with 100 hours of unpaid work and was disqualified from driving for three months. Additionally, he was ordered to pay costs of £522 and a victim surcharge of £95, for a total of £617. Neil Fairlamb, Manchester City Council’s Strategic Director for Neighborhoods, expressed gratitude to the resident who reported the incident and to the Environmental Crimes Team and legal officers who successfully prosecuted the case. He emphasized the council’s commitment to investigating fly-tipping incidents and bringing offenders to justice to protect the environment and ensure that residents have access to proper waste disposal facilities.
