Four Las Vegas restaurants, Esther’s Kitchen, Gaetano’s Ristorante, Manizza’s Pizza, and BabyStacks Cafe, have filed a class-action lawsuit against Uber, alleging fraud, conversion of funds, civil RICO, racketeering, and negligence in connection with the Uber Eats delivery service. The lawsuit, filed Wednesday in Clark County District Court, contends that Uber’s website and app allowed imposters to create fake restaurant pages using the plaintiffs’ names or similar names. These impostor pages allowed malicious actors to deceive customers and siphon business away from the legitimate restaurants. The lawsuit alleges that Uber was negligent or fraudulent in failing to require reasonable authentication from individuals claiming to be restaurants. Uber’s alleged failure to verify restaurant identities allowed the impostor restaurants to operate on the Uber Eats platform, harming the plaintiffs and other legitimate restaurants. The complaint further alleges that Uber took a thirty percent cut of all fraudulently obtained payments made through these unethical and illegal activities. The plaintiffs seek damages, injunctive relief, and other remedies for the alleged harm caused by Uber’s actions. Uber has not yet responded to the lawsuit.
