The U visa is specifically for victims of certain crimes who assist in investigations. The migrants worked with a Texas sheriff to expose the false promises and deception used by Florida officials. According to immigration attorney Rachel M. Self, more bona fide determinations are expected, as all the migrants were involved in the same scheme.
The U visa process includes a waiting list, but the bona fide determination provides protection and work authorization in the meantime. Sarah Sherman-Stokes of Boston University School of Law emphasizes the significance of these determinations, stating that politicians must face consequences for their actions.
Lawyers for Civil Rights in Boston is pursuing criminal and civil investigations into the scheme and has filed a federal lawsuit. However, the Bexar County district attorney has not taken any action, raising concerns from immigration attorney Self.
