Mark Cuban, the outspoken billionaire entrepreneur and ardent supporter of Vice President Kamala Harris, has stirred the pot in the crypto world. He’s publicly criticized SEC Chair Gary Gensler’s approach to regulating the burgeoning crypto industry, even suggesting he might be interested in the job himself should Harris win the presidency.
Cuban’s criticisms are sharp. He accuses Gensler of driving crypto businesses overseas through aggressive regulatory tactics, hindering growth in the capital markets, and engaging in what he describes as “witch hunts” for prominent figures in the crypto space. “He is pushing the crypto industry overseas,” Cuban said in an email to POLITICO on Monday. “He is perfecting regulation through litigation, stifling growth in the capital markets, reducing the number of companies going public and going on what seems like witch hunts for big names.”
Intriguingly, Cuban went so far as to suggest he would consider the SEC Chair position if offered, though he later clarified his remarks, stating he was merely “trolling.”
This back-and-forth has sparked a debate about the future of crypto regulation, particularly if Harris were to win the presidency. Some, like Blockchain Association CEO Kristin Smith, believe Cuban would be a welcome addition to the SEC, stating, “We would absolutely welcome Mark Cuban as chair of the SEC, if that’s the way Harris wanted to go.” However, others, like Jeff Hauser, executive director of the Revolving Door Project, see Cuban as unqualified for the role.
This debate highlights the ongoing tension between the crypto industry and regulatory bodies. It also raises questions about the direction Harris would take on financial regulation if she were elected president. While Cuban’s influence on her campaign is undeniable, the extent of his sway over potential SEC appointments remains unclear. Cuban himself acknowledges, “The one certainty is that [Harris] makes the final call. That is the response I have gotten over and again.”
