Mitchell Refuses Testimony in Ethics Hearing, Sparking Division

Democratic Minnesota state senator Nicole Mitchell declined to testify before an ethics panel Tuesday regarding the burglary charge she faces for allegedly breaking into her stepmother’s home last month.

Mitchell invoked her Fifth Amendment rights and remained silent throughout her appearance before the panel, which comprises two Democrats and two Republicans. Despite her refusal to testify, the panel remains divided on how to proceed regarding Mitchell’s future in the legislature.

Republican Sen. Eric Lucero expressed concern, stating, “Sen. Nicole Mitchell’s actions are a clear violation of Senate rules and leave the Minnesota Senate under a cloud of distrust.”

However, Democratic Sen. Bobby Joe Champion, chair of the panel, urged caution, suggesting they wait until the evidence can be thoroughly examined.

Mitchell’s refusal to testify follows her removal from committee assignments and caucus meetings after her arrest at her stepmother’s home on April 22. The state senator was subsequently charged with first-degree burglary.

Mitchell has denied the allegations, claiming she was merely checking on an ill loved one. A criminal complaint alleges that Mitchell entered through a window and informed investigators that she intended to retrieve her late father’s ashes, photos, a flannel shirt, and other sentimental items. She claimed her stepmother had ceased communication with her after her father’s death and refused to provide her with the belongings.

According to Mitchell’s attorney, Bruce Ringstrom Jr., she may enter a plea at her next court hearing on June 10, but the proceedings could potentially be delayed.

The panel’s decision to postpone further action until after the legislative session’s adjournment deadline of May 20 means that no additional steps will be taken for the time being.

Elected to represent Minnesota’s Senate District 47 in 2022, Mitchell previously worked as a meteorologist for KSTP-TV and Minnesota Public Radio. She also holds the rank of lieutenant colonel in the Air National Guard.
