Robin Mobley, a resident of Trotwood, Ohio, has been engaged in a relentless legal battle to reclaim her home after it was wrongfully transferred through a fraudulent quitclaim deed over a decade ago.
The fraudulent transaction occurred in 2012 when Rush Plaza Corp., owned by realtor Demetrious Rush, acquired ownership of Mobley’s property through a quitclaim deed without her knowledge or consent. Mobley alleges that Rush forged her signature on the document, transferring ownership without her authorization.
Mobley’s discovery of the fraud last year sent shockwaves through her life. Amidst her battle with lung cancer, she received a summons indicating her status as a defendant in a mortgage foreclosure case. Unbeknownst to her, the case had been proceeding through the court system for nearly a year.
Determined to reclaim her property, Mobley pursued criminal charges against Rush, but her efforts were hindered by his untimely death in 2017. The Montgomery County Prosecutor’s Office informed her that the case could not proceed due to Rush’s absence.
Compounding the injustice, Mobley’s home has accumulated over $13,000 in delinquent taxes during the period of unlawful ownership by Rush Plaza Corp. If she successfully reclaims her home, the responsibility for these unpaid taxes may fall upon her.
The incident has brought to light the growing prevalence of quitclaim deed fraud in the Mid-South region. Montgomery County Recorder Stacey Benson-Taylor reported a significant increase in complaints related to such fraudulent activities.
Mobley, driven by an unwavering determination, has chosen to represent herself in court despite the hefty estimated cost of an attorney. Undeterred by financial constraints and emotional distress, she is fighting not only for her own home but also for others who have become victims of similar fraudulent practices.
