The Delhi government’s plea challenges the central government’s May 19, 2022 ordinance, which transferred the control over services from the city dispensation to the lieutenant governor. The ordinance, later replaced by a central law, triggered a fresh tussle between the two power centers.
Senior advocate Abhishek Singhvi, appearing for the AAP government, urged the apex court to hear the matter, stating that the entire administration had come to a standstill. The bench led by Chief Justice of India D Y Chandrachud stated that they would consider the submission after the conclusion of the ongoing hearing by the nine-judge bench.
The nine-judge bench is currently hearing a matter related to Article 39(b) of the Constitution, which deals with the Directive Principles of State Policy, and the question of whether private properties can be considered as “material resources of the community.”
