Allahabad High Court Protects Adult’s Right to Marriage and Safety

In a significant ruling, the Allahabad High Court has upheld an adult’s constitutional right to choose their marriage partner and live with anyone they choose, under Article 21 of the Indian Constitution. The court quashed an FIR filed against a couple who married against the wishes of the woman’s uncle, stating that an adult citizen cannot be restricted from marrying or residing with a person of their choice. The judgment also highlighted the importance of protecting citizens from honor killings and the duty of the state to preserve human life. The court held the police responsible for failing to take action against the woman’s uncle and directed them to ensure the couple’s safety.
