Attorneys for former President Donald Trump are using a recent Supreme Court decision to bolster their argument for dismissing all charges brought against him by Special Counsel Jack Smith in the Jan. 6 case. They argue that the court’s ruling in Fischer v. United States, which narrowed the scope of the federal obstruction statute, undermines Smith’s legal theory and warrants dismissal of the charges related to obstruction and conspiracy. The case has been delayed until after the 2024 election.
