Arizona Secure the Border Act: Local Police Empowered to Arrest Illegal Crossers

Arizona’s Senate has approved a proposed ballot measure that would authorize local law enforcement to detain individuals illegally crossing the US-Mexico border into the state. The initiative, which passed along party lines, criminalizes unauthorized entry into Arizona and empowers state police and judges to arrest, sentence, and deport offenders. Supporters argue that the federal government’s failure to curb illegal crossings necessitates Arizona’s intervention. Opponents, including Governor Katie Hobbs, contend that the proposal will harm businesses, strain law enforcement, and contribute to racial profiling. The measure, which excludes DACA recipients and includes safeguards against retroactive application, now proceeds to the Republican-controlled House for approval. If passed by the legislature, it will bypass Governor Hobbs’ potential veto and be presented to Arizona voters for their decision on the November ballot.
