Texas Prosecutor Appeals Overturned Illegal Voting Conviction

The Tarrant County District Attorney’s Office announced on Thursday its appeal of a recent ruling that dismissed Crystal Mason’s 2018 conviction for illegal voting. The office maintains that the trial court’s guilty verdict should stand, emphasizing the importance of safeguarding the integrity of the ballot box.

In contrast, the Second Court of Appeals had previously overturned Mason’s conviction, citing insufficient evidence to prove beyond a reasonable doubt that she was aware of her ineligibility to vote. Mason was on supervised release for federal tax evasion at the time of the 2016 presidential election, which rendered her ineligible to cast a provisional ballot.

The prosecution contends that the evidence presented at trial was sufficient to establish Mason’s knowledge of her ineligibility and her intent to commit the offense. They argue that she violated a statute that specifically prohibits individuals from voting or attempting to vote when they are aware of their ineligibility.

The case has garnered national attention, sparking debates about voter rights and the consequences of casting an illegal ballot. The ACLU of Texas expressed disappointment in the state’s decision to appeal, expressing confidence that justice will ultimately prevail. They maintain that the court of appeals’ decision was well-reasoned and correct and that it is time for Mason to find peace with her family.
